  1. About this Policy

At JetStream Software, Inc. (“JetStream” or “we” or “us” or “our”), your privacy is important to us, and this Privacy Policy is designed to help you understand how JetStream will collect, use and disclose personal information we obtain through your use of our Website (“Jetstreamsoft.com” or “Website”). By accessing and using our Website, you are accepting the practices described in this Privacy Policy.

JetStream processes Website visitors’ information in accordance with this Privacy Policy.

JetStream collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring website, and the date and time of each visitor request. JetStream’s purpose in collecting non-personally identifying information is to better understand how JetStream visitors use its Website. From time to time, JetStream may release non-personally-identifying information in the aggregate. For example, by publishing a report on trends in the usage of our Website. JetStream may collect potentially personally-identifying information like Internet Protocol (IP) addresses. JetStream will not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

JetStream Software, Inc. collects, processes, and retains personal information in the form of an individual’s company contact information, including individual and company names, email addresses, phone numbers, job titles, LinkedIn and other social relationship media (“SRM”) URLs if they exist, in a subscription-based dedicated commercial cloud database of Software-as-a-Service (“SaaS”) provider Salesforce.com to the extent necessary to reasonably serve our Website visitors, in addition to trade show booth visitors who have requested information from us by email, and other customers’ and prospects’ requests for information by email that we encounter in various business circumstances individually.

Website visitors and other individuals referenced above with respect to inclusion in our Salesforce.com database may request certain details about what and how their information is shared with third parties for direct marketing purposes.

In summary, additional information collected on Website and trade show visitors, and other individuals referenced above is in the form of emails and meeting invitations subsequently exchanged with them by JetStream Software, Inc.’s employees utilizing Microsoft’s Office 365 Outlook or Salesforce.com email clients, as well as notes added into Salesforce.com from phone conversations, and from online and face-to-face meetings concerning JetStream’s cloud data management technology platform, and industry trends regarding our and competitors’ technologies and products, and which specific JetStream products these individuals have shown interest in or purchased.

Additionally, with respect to individuals who request information from us at trade shows by permitting us to scan their trade show badges for their contact information, Microsoft Excel (“Excel”) spreadsheets of those individuals’ contact information are subsequently sent to us by email attachment, or via portable flash device, from the trade show organizers. Those Excel spreadsheets are imported into JetStream’s Salesforce.com database.

Also, Excel spreadsheets containing minimal contact information, names and company email addresses from JetStream’s Salesforce.com database are provided to a mass email service, MailChimp.com, to execute periodic mass emails on JetStream’s behalf for product and trade show event marketing purposes as well as Privacy Policy update notices.

We do not actively seek, nor do we collect or store dates of birth, social security numbers, or any other personal information that typically might pose an identity theft threat if somehow Saleforce.com were compromised.

JetStream does not rent or sell potentially personally-identifying nor personally-identifying information to anyone, and to the best of our knowledge, the third party affiliated organizations mentioned above, Salesforce.com, Microsoft, and MailChimp.com do not share, sell, or otherwise distribute the personal data that JetStream shares with them in the normal course of business described above.

To opt out of having your information shared with third party vendors for direct marketing purposes, please inform us by sending an email request to [email protected] and we will promptly remove you from ALL correspondence.

This Privacy Policy does not cover your use of any of JetStream’s software products. Our customers use JetStream’s software products to manage and move data to and from public and private clouds. JetStream does not control the types of information that our customers may choose to collect, manage or store using JetStream’s software products. That information belongs to them, and is used, disclosed, and protected by them in accordance with their privacy policies and is not subject to this Privacy Policy.

  1. Gathering of Personally-Identifying Information

Certain visitors to JetStream may choose to interact with JetStream in ways that require JetStream to gather personally-identifying information. The amount and type of information that JetStream gathers depends on the nature of the interaction.

For example, we ask visitors who write to us through our Website forms to provide their name and email address. JetStream collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with JetStream.

JetStream does not disclose personally-identifying information other than as described below. Visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain Website-related activities.

We acknowledge that you have the right, upon written request, to review any information we have collected about you (typically, name, title, and email contact information).  If you request that we remove your personal information from our databases, we will respond within a reasonable timeframe to fully assess your request to confirm the deletion. For example, if you request that we delete all information pertaining to you, we will inform you prior to confirming the deletion that certain information, such as your email address, if deleted, will NO longer allow us to filter for that email address to maintain your Unsubscribe or Email Opt Out status should that email address be reintroduced into our databases due to legitimate trade show or other marketing activities.

  1. Aggregated Statistics

JetStream may collect statistics about the behavior of visitors to its Website. For instance, JetStream may reveal how many times a webpage was viewed, or how many times a document was downloaded from its website. However, JetStream does not disclose personally-identifying information other than as described below.

JetStream discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that:

(i) need to know that information in order to process it on JetStream’s behalf, or to provide services available at Jetstreamsoft.com, and

JetStream complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland transferred to the United States pursuant to Privacy Shield.

JetStream Software, Inc. has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. Upon request, we will provide you with access to the personal information that we hold about you. You may also may correct, amend, or delete the personal information we hold about you. JetStream retains your personal information to the extent necessary to reasonably serve Website visitors, trade show booth visitors, and customers requests for information and software, to meet our compliance and legal obligations, to enhance security and fraud prevention, and for audit purposes. We will keep your personal information until you instruct us to delete it or otherwise limit its use within the terms of this Privacy Policy.
